The man accused of sparking a massive wildfire near Brian Head in 2017 is headed for trial.

Yesterday, a judge refused to dismiss charges against 63-year-old Robert Lyman after his attorneys argued his actions did not meet the legal definition of recklessness.

The judge said the issue of recklessness will instead be decided by a jury.

Investigators say the fire started when Lyman lit a pile of branches he'd cleared from his cabin to better protect it from wildfires.

The fire burned nearly 70-thousand-acres and destroyed several buildings.

Trial is set for December.
